Privacy Policy

Our mission is to be the 21st-century platform dedicated to managing parking services for drivers, residential owners, and private operators. It is important for us to clearly communicate how we use your information and how we protect your right to privacy.

This Privacy Policy describes how 9413-8757 Québec Inc. ("we" or "clicknpark") processes personal information related to your use of the website, applications, and other offerings from clicknpark (collectively, the “clicknpark Platform”).

  1. PERSONAL DATA COLLECTED BY clicknpark

1.1 Information necessary to use the clicknpark Platform. clicknpark collects personal information about you when you use the clicknpark Platform. Without this information, clicknpark is unable to provide you with all requested services. This information includes:

1.1.1 Contact and account information. Your first name, last name, phone number, email address, and license plate number.

1.1.2 Identification information. If applicable, clicknpark may ask for your postal address, date of birth, a photo of your official identification (in accordance with applicable law), or other information to verify your identity, and/or a photo of you when clicknpark verifies your identification. If you provide us with a copy of your identification, clicknpark will collect information about your identification.

1.1.3 Payment information. This may include information about your payment card or bank account. If you are not a clicknpark Member, clicknpark may receive payment information about you. For example, when a Driver uses your payment card to make a reservation. This payment information is requested directly by our payment partner Stripe. Under no circumstances does clicknpark have access to your payment information and therefore cannot store it.

1.2 Information you choose to provide us. You may choose to provide us with additional personal information, including the following:

1.2.1 Additional profile information. This may include your gender, preferred language(s), city, and a personal description.

1.2.2 Information about third parties. This may include a payment method, contact details of another person. By providing personal information about others, you certify that you have authorization to provide this information to clicknpark for the purposes described in this Privacy Policy and that you have shared clicknpark's Privacy Policy with them.

1.2.3 Other information. This may include information provided when you fill out a form, add information to your account, respond to surveys, post in community forums, participate in promotions, communicate with clicknpark support, import or manually enter contacts from your address book, provide your address and/or geographic location, or share your experience with us.

1.3 Information automatically collected during the use of the clicknpark Platform. When you use the clicknpark Platform, clicknpark automatically collects certain information. This information may include:

1.3.1 Geolocation information. This may include precise or approximate location determined from your IP address, your mobile device's GPS, or other information you share with us based on your device settings. This information may also be collected when you are not using the app if you enable this option in your device settings or permissions.

1.3.2 Usage information. This may include parking searches, reservations you have made, additional services you have added, dates and times of access, pages you have viewed or interacted with before or after using the clicknpark Platform, and other actions taken on the clicknpark Platform, including pages or content you view and links you click to access third-party apps. clicknpark may collect this information even if you have not created a clicknpark account and even if you have never logged in.

1.3.3 Device information. This may include IP address, hardware and software information, device information, information about events recorded by the device, unique identifiers, crash data, and acknowledgments. clicknpark may collect this information even if you have not created a clicknpark account or have never logged in.

1.3.4 Cookies and similar technologies.

1.3.5 Payment transaction information. This may include the payment method used, date and time, payment amount, payment method expiration date, and billing zip code.

1.4 Information collected from third parties. We may collect personal information from other sources, including the following:

1.4.1 Third-party applications. If you choose to link, log in, or access the clicknpark Platform with a third-party service (such as Google, Facebook, or Apple), you request that service to send us information such as your registration number and profile information in accordance with the control settings of that service or as authorized by you in the privacy settings for that service. If you choose to associate a smart lock with your clicknpark account, clicknpark may collect information about the smart device, such as information or events recorded and device information.

1.4.2 Persons lodging claims. If a Member or third party lodges a claim against you, clicknpark may receive information about the claim filed in order to understand and, if necessary, process it.

1.4.3 Financial institutions. In certain cases, if you choose to pay with funds from your bank account, clicknpark may receive certain information from your financial institution, such as your bank details and your account balance.

1.4.4 Other sources. To the extent permitted by applicable law, clicknpark may receive additional information about you, such as references, demographic data, and information contributing to the detection of fraud and security breaches, from (i) third-party service providers, other third parties, and/or partners, or (ii) Members and other individuals, entities, and authorities, and then combine it with the information already in our possession about you. For example, clicknpark may receive fraud alerts from identity verification service providers and use them in our fraud prevention efforts, security investigations, and risk assessments. clicknpark may receive information about you and your activities collected on or off the clicknpark Platform, including from Members, members of the public, or governmental, public, or tax authorities, or about your experiences and interactions with our partners.

  1. HOW CLICKNPARK USES THE COLLECTED INFORMATION

2.1 Providing, Improving, and Developing the clicknpark Platform. clicknpark may process this information for the following purposes:

  • Allowing you to access the clicknpark Platform and make and receive payments.

  • Processing your requests.

  • Conducting analysis, debugging, and research.

  • Developing and improving our products and services.

  • Training customer support staff.

  • Sending you messages, updates, security alerts, and account notifications.

  • Personalizing your experience based on your interactions with the clicknpark Platform, your search and reservation history, profile information, and other content you submit.

  • Enabling you to use our rental services.

2.2 Protecting the clicknpark Platform and Community. clicknpark may process this information for the following purposes:

  • Detecting, preventing, assessing, and addressing fraud and security risks.

  • Verifying or authenticating the information you provided, including identity information, as described in the "Information Necessary to Use the clicknpark Platform" section.

  • Conducting checks against databases and other sources of information.

  • Complying with our legal obligations.

  • Resolving disputes with our Members.

  • Enforcing our contracts with third parties.

  • Determining eligibility for certain types of bookings.

  • Complying with the law, responding to legal requests, preventing harm, and protecting our rights (see the "Compliance with the Law, Responding to Legal Requests, Preventing Harm, and Protecting Our Rights" section).

  • Enforcing our Terms of Use.

  • Evaluating your interactions with the clicknpark Platform and information obtained from third parties.

In some cases, automated processes, which analyze your account and activities on the clicknpark Platform, as well as information related to activities on and off the clicknpark Platform that may be associated with you, may restrict or suspend your access to the clicknpark Platform if these processes detect activity presenting a security risk or other type of risk to clicknpark, our community, or any third party. If you wish to contest decisions based on automated processes, please contact us via the Support section.

2.3 Providing, Customizing, Evaluating, and Improving Our Advertising and Marketing. clicknpark processes this information for the following purposes:

  • Sending you promotional and marketing messages, and other information.

  • Displaying, customizing, evaluating, and improving our advertisements on advertising platforms.

  • Managing referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities sponsored or managed by clicknpark or its third-party partners.

  • Analyzing characteristics and preferences to send you promotional and marketing messages, advertisements, and other information that may interest you.

  • Inviting you to relevant events or other opportunities.

2.4 Analyzing and Sharing Your Communications. clicknpark may consult, review, or analyze your communications on the clicknpark Platform for the reasons outlined in the "How clicknpark Uses Collected Information" section of this Policy, including for fraud prevention, security investigations, risk assessment, regulatory compliance, product development, research, analysis, enforcement of our Terms of Use. For example, as part of our fraud prevention efforts, clicknpark scans and analyzes messages to redact contact information and references to other sites. In some cases, clicknpark may also review, verify, or analyze messages for debugging, improving, and extending the offered products. clicknpark uses automated methods where reasonably possible. However, clicknpark may occasionally manually review certain communications, for example, for fraud investigations and customer support or to evaluate and improve the features of these automated tools. clicknpark does not scan, scrape, or analyze your communications to send you third-party marketing messages and does not sell feedback or analyses of such communications. clicknpark may also share your communications as indicated in the "Sharing and Disclosure" section.

2.5 Providing Payment Services. Personal data is used to enable or authorize third parties to use our payment services, including for the following purposes:

  • Detecting and preventing money laundering, fraud, abuse, and security incidents, as well as conducting risk assessments.

  • Complying with legal and regulatory obligations (such as anti-money laundering regulations and sanctions enforcement).

  • Enforcing our payment policies.

  • Providing and improving payment services.

  1. SHARING AND DISCLOSURE

3.1 Who clicknpark Shares Information With. clicknpark may share your information with the following entities:

3.1.1 Parking Space Lessor. The reservation and personal data of Drivers, including their contact information, may be shared with the Lessor of the parking space subject to a reservation by that Driver, to facilitate rental services, compliance with applicable laws, security, billing, and other services.

3.1.2 Service Providers. clicknpark shares personal data with affiliated and unaffiliated service providers (including their service providers) to assist us in managing our business and for compliance purposes, including those that help us: (i) verify your identity or authenticate your identification documents, (ii) verify information against public databases, (iii) fraud prevention, security investigations, and risk assessments, (iv) develop, maintain, and debug products, (v) enable the provision of clicknpark services via third-party platforms and software tools (e.g., through integration with our APIs), (vi) provide customer support, advertising, or payment services, (vii) offer additional services you select, (viii) process, manage, or evaluate insurance claims or similar claims, or (ix) review, scan, and analyze communications on the clicknpark Platform for certain purposes (such as evidence of child exploitation). These providers are contractually obligated to protect your personal data and have access to your personal data to perform these tasks. They may also disclose it when required by law.

3.3 For What Purposes clicknpark May Transmit Your Information. clicknpark may share your information for the following purposes:

3.3.1 Creating Your Public Profile. Information you share publicly on the clicknpark Platform may be indexed through third-party search engines. In some cases, you may be able to disable this sharing in your account settings. clicknpark may make certain information publicly visible to others, such as:

  • Your profile and account information and related information.

  • Listing pages, which include information such as the approximate or precise description of the parking space location, calendar availability, profile photo, aggregated request information, and additional information you choose to share.

  • Public comments, ratings, and other remarks.

  • Content in a community or discussion forum, blog post, or social media article, and content you make available to the public, including details of the listing on third-party sites, platforms, and apps.

3.3.2 Compliance with the Law, Responding to Legal Requests, Preventing Harm, and Protecting Our Rights.

3.3.2(i) Disclosure. clicknpark may disclose your information to courts, law enforcement authorities, governmental or public authorities, tax authorities, authorized third parties, or other Members, if and to the extent clicknpark is required or authorized by law to do so or when disclosure is reasonably necessary to: (i) comply with our legal obligations, (ii) comply with a valid court order, such as a subpoena or court order, or to respond to claims against clicknpark, (iii) respond to a valid court order in connection with a criminal investigation into alleged or suspected illegal activity, or to respond to or address any other activity that may expose clicknpark, you, or any other user to legal or regulatory liability, (iv) enforce and administer our contracts with members, including our Terms of Use, (v) respond to requests from or in connection with current or potential legal claims or proceedings regarding clicknpark and/or third parties, in accordance with applicable law, or (vi) protect the rights, property, or personal safety of clicknpark, its employees, members, or the public.

3.3.2(i)(a) To Tax Authorities. When required or permitted by applicable law, clicknpark may disclose information about Lessors or Drivers to tax authorities or other governmental agencies, depending on your place of residence, so that tax authorities can determine compliance with applicable tax obligations.

3.3.2(i)(b) To Government Authorities for Registrations, Notifications, Authorizations, or License or Number Requests. In jurisdictions where, if applicable,  clicknpark encourages or requires an application for registration, notification, authorization, license acquisition, or number from a Lessor with a government authority, clicknpark may share information about participating Lessors with the relevant authority, both during the application process and when posting the listing, and periodically thereafter.

3.3.2(ii) Notification. Where applicable and/or if required by law, clicknpark may inform Members of the existence of judicial requests, unless: (i) notification is prohibited by the legal process itself, by a court order received by clicknpark, or by applicable law, or (ii) clicknpark believes that notification is unnecessary, ineffective, would create a risk of injury or bodily harm to an individual or group, or would create or increase a risk of fraud or harm to clicknpark or our Members, or would expose clicknpark to a charge of obstruction of justice.

3.3.3 Business Transfer. If the clicknpark business undertakes or participates in a merger, acquisition, restructuring, asset sale, or bankruptcy or insolvency proceeding, it will be entitled to sell, transfer, or share all or part of its assets, including your information related to such transaction or in anticipation of such transaction (e.g., due diligence). In such cases, clicknpark will inform you before your personal data is transferred and becomes subject to a different privacy policy.

  1. PARTNERSHIPS AND INTEGRATIONS WITH THIRD PARTIES

4.1 Linking Third-Party Accounts. You can link your clicknpark account to certain third-party services such as social networks. When you redirect data sharing by creating this link:

  • Some of the information provided to us from the linking of accounts may be posted on your public profile.

  • The information you provide us by linking your accounts may be stored, processed, and transmitted for fraud prevention, security investigations, and risk assessment purposes.

  • We share information about your booking with rewards programs.

  • The publication and display of information you provide to the clicknpark Platform through this link are governed by your settings and permissions on the clicknpark Platform and the third-party service.

4.2 Terms of Third-Party Services. Some parts of clicknpark may be linked to third-party services. clicknpark does not own or control these third parties. When you interact with these third parties and choose to use their service, you provide them with your information. Your use of these services is subject to the privacy policies of these providers, including, where applicable, the additional Terms of Use for Google Maps/Earth, Google's Privacy Policy, and Stripe's Privacy Policy.

  1. YOUR RIGHTS. Applicable law grants you rights. While some of these rights apply generally, some only apply in limited cases. clicknpark may ask you to confirm your identity before fulfilling your request.

5.1 Access and Portability. You have the right to request certain copies of your personal data in our possession. In some cases, you also have the right to request copies of personal data you provided to us in a structured, commonly used, machine-readable format and/or request us to transmit this information to another service provider (if technically feasible).

5.2 Correction. You have the right to request us to correct inaccurate or incomplete personal data about you (and that you cannot update yourself in your clicknpark account).

5.3 Deletion. In general, clicknpark retains your personal data for as long as necessary to fulfill our contract with you, and to comply with our legal obligations. You have the right to request us to delete your personal data (subject to certain limitations and restrictions). Note that if you request us to erase your personal data:

  • 5.3.1 Legitimate Business Interests. clicknpark may retain your personal data when our legitimate business interests require it, such as for preventing money laundering, detecting and preventing fraud, and improving security. For example, if clicknpark suspends a clicknpark account for fraud or security reasons, clicknpark may retain the information from that clicknpark account to prevent the Member from opening a new clicknpark account in the future.

  • 5.3.2 Legal, Tax, Reporting, and Audit Obligations. clicknpark may retain and use your personal data to the extent necessary to comply with our legal, tax, reporting, and audit obligations.

  • 5.3.3 Shared Information. Information you have shared with others, such as comments and posts on forums, may continue to be public on clicknpark even after deletion of your clicknpark account.

  • 5.3.4 Residual Copies. Since clicknpark maintains the clicknpark Platform to protect it from accidental or malicious loss and destruction, residual copies of your personal data cannot be deleted from our backup systems for a limited period.

5.4 Filing Complaints. You have the right to file a complaint regarding our data processing activities with our Privacy Officer. 

  1. MODIFICATIONS TO THIS PRIVACY POLICY. clicknpark reserves the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will publish the revised Privacy Policy and update the "last updated" date at the top. In the event of significant changes, we will seek your consent to the new Privacy Policy. If you disagree with the revised Privacy Policy, you may choose not to accept it and deactivate your account. If you accept the revised Privacy Policy, your continued access to the Clicknpark Platform or your use thereof will be governed by the revised Privacy Policy.

  2. WHO IS RESPONSIBLE FOR PROCESSING MY PERSONAL INFORMATION. The terms "clicknpark," "we," "our," or "us" as used in this subsection refer to the 9413-8757 Québec Inc. company.  The person responsible for your information under this Privacy Policy (the "Privacy Officer") is indicated in Annex 1.

  3. RETENTION. clicknpark retains personal data for as long as necessary or as permitted by law for the purposes for which it was obtained and in accordance with applicable law. Here are some criteria used to determine the retention period:

  • The duration for which clicknpark maintains a relationship with you as a Member and provides you with access to clicknpark services (for example, as long as you have a clicknpark account or continue to use clicknpark).

  • If there is a legal obligation to which clicknpark is subject (for example, certain laws, such as anti-money laundering requirements, require clicknpark to retain records of your transactions for a certain period before they can be deleted).

  • And/or if retention is desirable considering our legal position or to protect the security of individuals (for example, regarding applicable statutes of limitations, litigation, or regulatory investigations).

  1. DEFINITIONS. Terms not defined in this Privacy Policy have the same definition as indicated in our Terms of Use.
